What is the Shops & Establishments Act?
The Shops and Establishments Act is a state-level legislation that regulates the conditions of work and employment in commercial establishments, shops, restaurants, theatres, and other places of business. Each state in India has its own version of this act, leading to significant variation in requirements. The act covers working hours, rest intervals, weekly holidays, leave entitlements, employment of women and young persons, wages, and conditions of service.
Who Must Register?
Every shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment must register under the applicable state act. This includes offices, warehouses, and IT/ITES establishments. The only exemptions are typically government offices and establishments governed by the Factories Act.
