What is the Shops & Establishments Act?

The Shops and Establishments Act is a state-level legislation that regulates the conditions of work and employment in commercial establishments, shops, restaurants, theatres, and other places of business. Each state in India has its own version of this act, leading to significant variation in requirements. The act covers working hours, rest intervals, weekly holidays, leave entitlements, employment of women and young persons, wages, and conditions of service.

Who Must Register?

Every shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment must register under the applicable state act. This includes offices, warehouses, and IT/ITES establishments. The only exemptions are typically government offices and establishments governed by the Factories Act. Registration must be obtained within 30 days of commencing business in most states.

Employers must comply with several key obligations: (1) Display the registration certificate prominently at the premises, (2) Maintain prescribed registers for attendance, wages, and leave, (3) Ensure work hours do not exceed the daily and weekly limits set by the state, (4) Provide the minimum number of holidays and leave days as mandated, (5) Pay overtime wages at double the ordinary rate, (6) Provide suitable rest intervals, and (7) Follow rules regarding employment of women during night hours.

Leave entitlements vary by state. Most states mandate: Earned Leave — 1 day for every 20 days worked (approximately 15-18 days per year), Sick Leave — 7-12 days per year depending on the state, Casual Leave — 7-12 days per year, and National & Festival Holidays — as per state government notifications. Employers must ensure their leave policies meet or exceed these minimums.

Recent Reforms & Digital Compliance

Several states have modernized their S&E Acts in recent years. Maharashtra, Karnataka, Tamil Nadu, and Rajasthan now offer online registration and renewal. Some states like Karnataka and Tamil Nadu have introduced lifetime registration validity, reducing renewal burden. The upcoming Occupational Safety, Health and Working Conditions Code, 2020 is expected to subsume state S&E Acts into a unified national framework, though state-level rules will still apply for operational details.
